Please carefully read these terms and conditions of use ("Terms of Use"), as they govern your access to and use of Zellig Health LLC (“Zellig Health”, "we", "us" or "our") Platform. Your acceptance of and compliance with these Terms of Use is a condition to your use of the following:

The non-medical business support services, including our Website, are collectively referred to as our "Platform."

Zellig Health LLC contracts with Zellig Psychiatry PC, an independent professional corporation with a network of U.S.-based healthcare providers (each, a "Provider"), to provide online telehealth clinical consultations, services, and/or treatment. The professional medical services provided by Zellig Psychiatry PC through the use of our Platform are collectively referred to as the "Medical Services" in these Terms of Use.

The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of the Site constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy for your reference.

The Site is an informational platform aimed at providing details about our virtual mental health services, including psychiatric evaluation, medication management, and other resources related to mental wellness.

Privacy

Your use of the Site is subject to our Privacy Policy, which governs how we collect, protect, and disclose your information. Please review our Privacy Policy for details.

Consent to Receive Calls and Text Messages

By providing your phone number and completing forms on our Site, you authorize and agree to be contacted by or on behalf of Zellig Health via phone calls and text messages related to your care or service (e.g., appointment reminders, confirmations, billing matters).

Text Messages: You understand that text messages are not encrypted and may be accessed by third parties. Message and data rates may apply.

Opt-Out: To opt out of text messages, reply “STOP” to any message.

Consent to Communicate Electronically

By signing up for services, you consent to receive communications from us electronically via email.

Opt-Out: To opt out of email communication, follow the unsubscribe instructions included in the email or contact us at practice@zelligcare.com.

Electronic Communications

Visiting our Site or sending emails to Zellig Health constitutes electronic communications. By doing so, you consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

Children Under Thirteen

Zellig Health does not knowingly collect personal information from children under the age of thirteen. If you are under 13, you may use our services only with the permission of a parent or guardian and where permitted by applicable law.

Our Site may contain links to third-party websites (“Linked Sites”). The Linked Sites are not under the control of Zellig Health, and we are not responsible for the contents, services, or changes to any Linked Site. These links are provided as a convenience, and their inclusion does not imply endorsement.

No Unlawful or Prohibited Use

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site. You agree that you will not use the Site for any unlawful purpose or in any manner that could damage, disable, overburden, or impair it. Intellectual Property Rights

All content on the Site, including text, graphics, logos, images, and software, is owned by Zellig Health LLC, Zellig Psychiatry PC, or our licensors and is protected by copyright and other intellectual property laws. International Users

Our Services are operated from the United States. If you access the Site from outside the United States, you are responsible for compliance with local laws. You may not use the content in any way prohibited by applicable laws or regulations.

Indemnification

You agree to indemnify, defend, and hold harmless Zellig Health LLC, Zellig Psychiatry PC, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

Arbitration

In the event of a dispute arising out of or relating to these Terms or your use of the Site, the dispute will be resolved by binding arbitration conducted by a neutral arbitrator under the rules of the American Arbitration Association. Both parties agree to waive any rights to pursue class action litigation or class arbitration.

Class Action Waiver

Any arbitration or legal proceeding will occur on an individual basis. Class action lawsuits, collective actions, or representative proceedings are not permitted. You agree to bring claims only in your individual capacity.

Liability Disclaimer

The information on the Site may contain inaccuracies or typographical errors. The Site and Services are provided "as is" and "as available" without warranties of any kind, either express or implied. Zellig Health LLC and Zellig Psychiatry PC disclaim all warranties regarding the accuracy, reliability, and fitness of the information, products, and services provided on the Site.

To the maximum extent permitted by law, Zellig Health LLC and Zellig Psychiatry PC will not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with the use of the Site or Services.

Termination of Access

Zellig Health reserves the right to terminate or restrict your access to the Site at any time, without notice, for any reason. These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any court proceedings permitted under these Terms shall be brought in a court of competent jurisdiction in Pennsylvania.

Zellig Health reserves the right to modify these Terms at any time. The most current version of the Terms will supersede all previous versions. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
